ZeroCode Ventures is the controller for the processing of your personal data. We are registered with the Chamber of Commerce under number 14096351 and established in Parkstad, South Limburg, the Netherlands.

We process the following categories of personal data:

• Name — to address you personally;
• Email address — for communication and invoicing;
• Company name — for business relations;
• Phone number — for contact via WhatsApp or phone;
• AI employee conversation content — messages that end users send to your AI employee.

We process your data for the following purposes:

• Service delivery: configuring, maintaining and improving your AI employee;
• Contact: responding to questions and providing support;
• Invoicing: preparing and sending invoices;
• Security: protecting our systems and your data against unauthorised access.

We process your personal data on the basis of the following legal grounds (art. 6 GDPR):

• Performance of a contract: processing is necessary for the performance of the service;
• Legitimate interest: for security purposes and improvement of our services;
• Consent: for processing for which we ask your explicit consent, such as marketing messages.

We do not retain your personal data longer than necessary for the purposes for which it was collected:

• Invoice data: 7 years (statutory retention obligation);
• AI employee conversation content: maximum 12 months after the last interaction;
• Configuration data: for the duration of the agreement, then maximum 30 days;
• Contact form data: maximum 12 months.

We use the following third parties who may process your personal data:

• Anthropic, PBC (US) — AI models;
• OpenAI, LLC (US) — AI models;
• Google LLC (US/EU) — AI models (Gemini/Vertex);
• Mistral AI SAS (EU, France) — AI models;
• Hetzner Online GmbH (DE) — server hosting;
• Meta Platforms / WhatsApp LLC (US) — messaging platform.

Data processing agreements in accordance with art. 28 GDPR are in place (or will be concluded) with all processors.

When using AI model providers (Anthropic, OpenAI, Google), your data may be transferred to countries outside the European Economic Area (EEA), including the United States.

We have taken appropriate safeguards for this, including Standard Contractual Clauses (SCCs) as approved by the European Commission. By using our services, you consent to this transfer.

Under the GDPR, you have the following rights:

• Access: you can request which data we process about you;
• Rectification: you can have incorrect data corrected;
• Erasure: you can request deletion of your data (“right to be forgotten”);
• Restriction: you can request restriction of processing;
• Objection: you can object to processing based on legitimate interest;
• Data portability: you can request your data in a commonly used format.

Requests can be submitted via info@zerocodeventures.nl. We will respond within 30 days. You also have the right to lodge a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

In the event of a (suspected) data breach, we will notify you as a client within 72 hours of discovery, where reasonably possible.

As the controller, you are responsible for reporting to the Data Protection Authority if the data breach is notifiable.
